ACES Bill Passes the House

Late last Friday, the American Clean Energy & Security Act of 2009 (ACES), also known as the Waxman-Markey bill or the Cap and Trade, passed in the House with a 219 to 212 vote. Most people are aware of the cap and trade sections of the bill, but the ACES bill also addresses commercial building energy efficiency and energy renovations. If passed by the Senate, the bill will affect all of us in the building industry.

The ACES bill states that the "national average percentage improvement of a building's energy performance" for most new commercial buildings would be immediately reduced to 30% below ASHRAE Standard 90.1-2007. In 2014, it would be reduced to 50% below ASHRAE 90.1. Then, starting in 2018 and going through 2030, additional reductions of 5% below ASHRAE 90.1 would take effect every three years.

The bill also provides for support of an awards structure for owners conducting effective retrofits. It provides funding up to $500 toward an energy audit prescribing improvements resulting in at least a 20% efficiency improvement and additional awards based on square footage and energy reduction amount as follows:

• $0.15/sq ft of retrofit area for demonstrated energy use reductions from 20% to 30%
• $0.75/sq ft for demonstrated energy use reductions from 30% to 40%
• $1.60/sq ft for demonstrated energy use reductions from 40% to 50%
• $2.50/sq ft for demonstrated energy use reductions exceeding 50%

The Senate vote is expected to be in October. It will be interesting to see how the Senate votes and how that will effect the new construction and retrofit markets.

PennBarry Joins the U.S. Green Building Council

The U.S. Green Building Council (USGBC) is a non-profit composed of leaders from every sector of the building industry working to promote buildings that are environmentally responsible, profitable and healthy places to live and work.

Fans in the HVAC system are key components of most mechanical systems, and major users of energy. PennBarry is committed to help the industry improve the efficiency of fans and reduce their energy consumption in buildings to achieve net-zero by 2030.

As a member company, PennBarry will be able to serve on a LEED or USGBC committee and help shape the future of LEED and green building. Company members also vote for the Board of Directors and participate in ballots of the LEED Rating System.
